Purchase Policy:
The information on these pages is important. It explains the responsibilities and obligations undertaken by all parties when booking an event with The Big Night Out Company (UK) Ltd. When you, being the signatory to the booking, or the lead name and acting on behalf of other members of your party, make a booking with The Big Night Out Company (UK) Ltd, it is accepted, a contract is legally made with obligations and rights on your side and ours, as set down below which, unless agreed in writing by each of us, cannot be changed nor be undermined by any verbal understanding. These terms and conditions are subject to change at any time.
The Contract Between the Different Parties:
These Booking Conditions form the basis of your contract with The Big Night Out Company. In these booking conditions ‘you’ and ‘your’ are references to yourself, as signatory to the booking. By signing the booking form or agreeing to these terms and conditions, you confirm that you agree to be bound by these booking conditions. References to ‘we’, ‘are’, and ‘us are references to The Big Night Out Company. The term ‘event’ means trip, excursion or otherwise travel arrangement. The contract between us is governed by English Law and any dispute will be dealt with under the exclusive jurisdiction of the English Courts.
Please note, changes to these booking conditions or to any of the information appearing in our promotional material will only be valid if expressly agreed by us in writing. When we have confirmed your booking by issuing an e-ticket which will act as a receipt for full payment, a contract exists under which we accept responsibility for the provision of all services described on our invoice.
Payment:
- The cost of the event varies between £15 - £25 depending on the name of the event and location from which it is running from. Upon making a booking, you will then receive a confirmation of booking and a receipt from PayPal, you will then receive a full eticket from The Big Night Out Company, usually within 24 hours of the original booking.
- The Big Night Out Company do not accept deposits to be made for the booking.
- Your full itinerary and any other relevant documentation will be sent to you around 7 days before departure if it is not on your eticket.
- On receipt of confirmation of your booking, you must check your documentation (including itineraries and tickets) and inform us immediately if it is not correct otherwise we cannot accept liability for any inaccuracies. We regret we cannot accept any liability if we are not notified of any inaccuracy in any document within 10 days of our sending it out.
- The price of your trip is fully guaranteed at that time that it was booked (subject only to the correction of errors). We reserve the right to correct errors in both advertised and confirmed prices. We will do so as soon as we become aware of the error. Please note: As The Big Night Out Company is accepting the risk of increased costs on your behalf, we are unable to reduce our prices or make any refunds if in fact costs reduce or exchange rates fluctuate favourably.
Insurance:
- It is strongly recommended that all passengers travel with a fully comprehensive policy that they are acquainted with.
- Should you or any members of your party not take out any insurance, you absolve us of all possible liabilities and consequences in respect of matters that otherwise would be covered.
Special Requests:
- Although we will endeavour to pass any reasonable requests on to the relevant supplier, we regret we cannot promise that any requests will be complied with unless we have specifically confirmed this in writing. Confirmation that a special request has been noted or passed on to the supplier on the inclusion of the special request on your confirmation or any other documentation is not confirmed that the request will be met. Unless and until specifically confirmed, all special requests are subject to availability.
- If you or any member of your party has any medical problem or disability which may affect the event arrangements of that person, please tell us before you confirm your booking so we can advise as to the suitability of the chosen event. In any case, you must give us full details in writing at the time of the booking. If we feel unable to properly accommodate the particular needs of the person concerned, we must reserve the right to decline/cancel their reservation.
Departure and Arrival Times:
- When travelling by coach you must be at your pick up point 15 minutes before the departure time, final details of which, including the pick-up point, will accompany your travel documents.
- Regardless of mode of transport it must be accepted that delays can occur. If travelling by coach you will understand that be it due to weather condition, mechanical failure, traffic, an accident or some other reason the location of any delay cannot, even with all due care be predicted, nor the circumstances or conditions that may exist. Accordingly we cannot accept liability for any inconvenience or expenses you may incur.
- In the event of a delay due to mechanical failure or an accident, we undertake to do our utmost to remedy the problem or to arrange an alternative vehicle as soon as possible. We will make every effort to operate coaches of the standard described but cannot accept a claim on the basis of an inferior vehicle being used as a relief or replacement or in cases of ‘Force Majeure’. A delayed coach may necessitate reduced meal, toilet and ‘leg stretch’ stops.
- The time of your departure will be clearly identified on your e-ticket, as will the pick-up point. If it is not, a further email confirming all this information will be sent to you within 7 days of departure.
- There is to be no eating on the coach.
- Any damage to the vehicle due to a lack of due care and diligence by a passenger will be liable to the signatory of his or her ticket. Legal action will be taken in the case of a dispute.
- Any behaviour by you, which we deem to be a threat to the health and safety of other passengers, will be dealt with severely and you will be ejected from the vehicle and the relevant authorities will be informed
Your Luggage:
- You are not permitted to bring luggage than what you would otherwise expect to be carrying on a regular day. We reserve the right to refuse your entry onto the vehicle should we deem your baggage excessive.
- Any luggage or possessions which you leave on the coach whilst you are not present are solely at the risk of you. All clubs we visit provide adequate cloak rooms which we advise you to use.
- Any offensive weapons (knives, guns etc.) and drugs are strictly prohibited and will be confiscated and you will be refused entry / ejected from the vehicle.
Cancelling Your Place:
The Big Night Out Company will only accept refunds when requested in writing to refunds@thebignightoutcompany.co.uk if it is not within 7 days of the event for which you have booked on.
If We Make A Change To Your Booking:
a) Minor and significant changes
The arrangements for The Big Night Out Company are put together in good faith and many months in advance and we must therefore reserve the right to make alterations to and correct any errors to the event details before and after your booking has been confirmed. Changes will mostly be minor such as changes to coaches, departure times of less than 12 hours or the withdrawal of certain facilities. These are operational changes and not significant ones entitling you to cancel without penalty. Such changes will therefore not be specially notified to you and will simply appear on your travel documentation. Unfortunately it is sometimes necessary to make significant changes. If a significant change to the event arrangements is made, we will advise you as soon as reasonably possible (if there is time before your departure) when you will have the choice of;
- Accepting the changed arrangements as notified to you or
- Purchasing another event from us, of at least the same standard if available (and paying supplement or receiving a refund in respect of any price difference) or
- If we have to make a significant change, refunds will not be issued to anyone who does not give us notice of cancellation more than 72 hours before the event, because otherwise it does not give us enough time to resell your place.
No compensation is payable for minor changes. Minor changes do not entitle you to cancel or change to another event without paying our nominal charges:
If a significant change is made as a result of unusual and unforeseeable circumstances beyond our control, the consequences of which we could not have avoided even with due care which include but are not limited to those circumstances set out under the heading Force Majeure., compensation we regret cannot be paid. We regret we can not meet any costs or expenses you incur as a result of any change.
b) Can we cancel an event
We may sometimes be forced to cancel an event as all events are subject to a minimum number of clients. This happens on very rare occasions when it becomes impossible to run a particular event. We must therefore reserve the right to cancel any arrangements at our discretion. Please see note below. Where your event is cancelled other than due to your default in payment, we will offer you the choice of either purchasing an alternative event of at least the same standard (if available), (and paying or receiving a refund in respect of any price difference) or receiving a full and immediate refund of the cost of the event. In addition, we will pay you compensation as set out in clause 13 (a) above subject to the following exceptions.
Compensation will not be payable and liability beyond offering the above mentioned choices can not be accepted where we are forced to make a change as above subject to the following exceptions. In all cases, our liability is limited to offering the above choices and the compensation set out as in clause 13 (a) (where applicable). We regret we cannot meet any expenses or costs you incur as a result of any cancellation. No compensation is payable where we cancel more than 2 weeks before departure. Very rarely, we may be forced to cancel or curtail your event after the date of departure where circumstances amounting to ‘force majeure’ (as described in the special note below) occur.
In this very unusual situation we regret we cannot make any refunds, pay any compensation or be responsible for any costs or expenses you may incur as a result.
Special note – Force Majeure except where otherwise specified in these booking conditions, we regret we cannot accept liability or pay any compensation where the performance or prompt performance of our contractual obligations is affected by reason of circumstances amounting to ‘force majeure’. In these booking conditions ‘force majeure’ means any event which we or the supplier of the services in question could not, even with all due care, foresee or avoid. Such events may include war or threat of war, riots, civil strife, terrorist activity, industrial dispute, natural or nuclear disaster, adverse weather conditions, fire and similar events beyond our control.
Your Supervisory Responsibilities:
Once the booking form has been signed, it is your responsibility to ensure you behave accordingly whilst on the event. Furthermore you must ensure that:
- You are at least 18 years of age.
- All local laws relating to the consumption of alcohol are at all times obeyed
- You do not smoke on the coach
- You act in a responsible fashion and do not behave in a way likely to cause damage to property or offence or danger, to other people
If the behaviour of any member on the event is causing or is considered likely to cause offence, danger, damage to property and/or distress to others, we reserve the right at all times, without prior notice, to terminate the event of the person(s) concerned or, at our discretion, that of the whole party. If a senior member of our staff, considers that the behaviour is unacceptable they are authorised to terminate a booking wherever and whenever necessary and require the person(s) to leave the club or coach. In this situation, we will have no further responsibility to such person(s) including any return travel arrangements. No refunds will be made and we will not pay any expenses or costs incurred as a result of termination.
If there is any damage caused to the property of The Big Night Out Company or any of our suppliers, caused by lack of due care and diligence or unacceptable behaviour, you will be held legally accountable by the terms of conditions of the event which, by attending, you have agreed to. You will be required to meet any cost incurred by your actions.
Dealing With Problems
If a complaint arises you should report it as quickly as possible to our so that efforts can be made to rectify it to your satisfaction. Our representative or emergency contact can deal with most problems on the spot. If we are unable to resolve matters, you must email us at complaints@thebignightoutcompany.co.uk within 20 days of return, explaining the problem fully. Except in the case of personal injury, illness or death, we regret we cannot accept any liability in respect of any complaint or claim not notified to us within 10 days of return. We undertake to acknowledge receipt of your letter within 14 days and within 28 days to send you a full reply or an explanation for the delay. In any event we undertake to send you a full reply within 56 days.
Our Liability to You
We accept responsibility for ensuring your event is supplied as described in any promotional material subject to your agreement with us and that services offered reach a reasonable standard. If any part is not provided as promised we will pay you appropriate compensation if this has affected the enjoyment of your event. We accept responsibility for the act and/or omissions of our employees, agents and suppliers when acting within the scope of their employment except where they lead to death, injury or illness. Our liability however is in all cases limited to twice the price of the event excluding insurance premiums and amendment charges of the person affected.
We will not be liable for any circumstances which arise due to excessive consumption of alcohol, including refusal of entry to the club or coach, or from personal injury and death, which could have foreseen or avoided with due care.
On the Night:
- You will be asked for proof of age identification at any or all of our participating venues. ONLY a driver’s licence photocard and/or a UK Passport or Country of Origin passport will be accepted for the purpose of proving that you are over the age of 18 years. No proof of age identification will result in entry to any and/or all of our participating venues being refused. Refunds will NOT be possible under any circumstances.
- NO student/NUS cards will be accepted as proof of age identification. Incorrect forms of identification will result in entry to any and/or all of our participating venues being refused. Refunds will NOT be possible under any circumstances.
- At certain venues, you may be asked to produce your NUS/Student Card to prove your student status. You MUST ensure that you bring your NUS/Student Card identification with you to each event and present the identification at each venue, upon request. If you fail to provide this, any of our participating venues have the right to refuse you entry to any venue and/or all venues. Refunds will NOT be possible under any circumstances.
- If the venue, coach driver or Big Night Out representatives deem that you have drank excessive amounts of alcohol, you will be refused entry. Refunds will NOT be possible under any circumstances.
- Any wristband/t-shirt which you purchase for any Big Night Out event is/are ONLY valid on the date specified and printed on the front and reverse of the t-shirt/t-shirts which you have purchased.
- We will NOT be responsible for any wristbands/t-shirts that are lost or stolen. We are unable to accept any liability or replace any wristbands/t-shirts lost, stolen or damaged after they have been received by you.
- The Big Night Out Company accept no responsibility for any personal property. This includes any property deposited in any cloak rooms, at any of our participating venues.
- People on the Big Night Out event consent to filming and sound recording as participants of the event.
- People on the Big Night Out event consent to being photographed as participants of the event. The use of any photographs taken will be solely used for the purposes of our marketing operations, to include, flyers, posters, banners and any form of digital marketing practices operated by The Big Night Out Company.
- It is prohibited to bring any drugs or weapons (or anything that can be construed as a weapon) on Big Night Out event. Anyone found to be in possession of an drugs or weapons will have their place cancelled and reported to the police.
The Big Night Out Company as a Ticket Agent
Occasionally, The Big Night Out Company, sells tickets and services on behalf of other companies and for events not exclusively organised by The Big Night Out Company. In this instance, please consult the relevant Terms & Conditions. The Big Night Out Company cannot be held liable and responsible for events not organised by The Big Night Out Company.
The Big Night Out Company Privacy Policy
The Big Night Out Company has created this privacy statement in order to demonstrate our firm commitment to the privacy of the details that you provide us when using this web site ("Site"). When you use the Site, you are consenting to the practices set forth in this Privacy Policy.
Your IP Address
We use your IP address to help diagnose problems with our server and to administer the Site. Your IP address is also used to help identify you and to gather broad demographic information about you. Your IP address may also be used to assist in the detection of fraud and we may pass this information to the police.

Our Site's registration forms, order forms, surveys, competitions and prize draws require you to give us personal information (like your name, address and/or email address). If you are ordering tickets, you will be asked to provide financial information (like your account or credit card numbers).

The Big Night Out Company sells places for Big Night Out events. Your personal information is shared between The Big Night Out Company and its Event Partner for the particular event for which you are buying a place in accordance with this Privacy Policy. Your personal information is used by us to contact you by phone or by email when necessary in connection with transactions entered into by you on the Site.
You may well be, from time to time, notified of upcoming events and offers put forward by The Big Night Out Company. This notification will be electronic, either by SMS or email, or both. You are given the opportunity to unsubscribe to this service by replying to this message by writing ‘STOP’.

Your personal information may also be provided to carefully selected third parties that may contact you by post or email with information or offers regarding their goods and services.
